As far as the licensing rights go, Marvel is still clear to use any Marvel character in their video games, provided they don't have the exact likeness of the characters in the movies that other companies hold the license to. LEGO Marvel Heroes has the X-Men and Fantastic Four, and they didn't have to jump through any hoops to get them in. The same holds true for the Marvel Heroes MMO for the PC, Marvel: Avengers Alliance of Facebook, and the Marvel Ultimate Alliance games for the consoles.
The main reason we are not likely to see the Fantastic Four or X-Men characters is that Marvel is starting to phase out these characters in other formats (such as games, trading cards and comics) so they are not actively contributing to the success of the the upcoming motion pictures. This way if the motion pictures tank, they stand a better chance to bring these wayward souls home to the Marvel Cinematic Universe, as they have recently done with Spidey.
